Welcome to Betül Saday. The terms "we", "us", and "our" refer to BETUL SADAY COUTURE FZ-LLC, a Free Zone Limited Liability Company registered in Dubai, United Arab Emirates, with its registered office at Sapphire Tower, Dubai, United Arab Emirates ("Betül Saday").

Betül Saday operates the website en.betulsaday.com (the "Site"), through which we offer made-to-order couture wedding dresses, evening gowns, and related products ("Products"), along with associated information, content, features, tools, and services (collectively, the "Services"). Our Services are powered by Shopify, which enables us to make the Services available to you.

These Terms of Service, together with all policies referenced herein (including our Return and Refund Policy, Privacy Policy, and Cookie Policy) — collectively the "Terms" — describe your rights and responsibilities when using the Services.

Please read these Terms carefully, as they contain important information about your legal rights, including disclaimers of warranties and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Section 1 — Eligibility and Account

1.1 Age Requirement

To use the Services or place an order, you must be at least 16 years of age. If you are between 16 and the age of majority in your country of residence (typically 18 or 21), you confirm that you have obtained the consent of a parent or legal guardian to use the Services and place orders.

We reserve the right to refuse service, cancel orders, or terminate accounts where we reasonably believe the user does not meet the age requirements.

1.2 Account Registration

To make a purchase, you may be asked to provide information such as your name, email address, billing address, shipping address, and payment details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all necessary rights to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our Products

2.1 Made-to-Order Nature

All Products sold through the Site are made-to-order. Each garment is crafted by hand in our atelier from imported fabric, according to the size, colour, and specifications selected at the time of order. We do not maintain ready-to-ship stock through the Site.

Production timelines, return rights, and cancellation policies are governed by our Return and Refund Policy, which forms an integral part of these Terms.

2.2 Handcrafted Variations

Because our Products are crafted by hand, minor variations in beadwork placement, embroidery, hand-applied stones, fabric grain, and trim are inherent to authentic couture and are an expression of genuine craftsmanship. Such variations are not considered defects.

2.3 Colour and Visual Representation

We make every effort to display our Products accurately. However, colours and visual appearance may vary depending on the device, screen calibration, lighting, and photographic conditions. We do not guarantee that the appearance of a Product on your screen will exactly match the finished garment.

2.4 Product Availability and Modifications

All Product descriptions, prices, and availability are subject to change at any time, in our sole discretion and without notice. We reserve the right to discontinue any Product, limit the quantity of any Product offered, and restrict availability to certain persons, geographic regions, or jurisdictions.

Section 3 — Orders

3.1 Order Process

When you place an order through the Site, you make an offer to purchase. Betül Saday reserves the right to accept or reject any order at its sole discretion. Your order is not accepted until we confirm acceptance, which typically occurs when we send you the order confirmation email and your payment has been successfully processed.

If we are unable to accept, must modify, or must cancel your order, we will attempt to contact you using the email address, billing address, or telephone number provided at the time of order.

3.2 Cancellation Window

You may cancel your order within 24 hours of order confirmation, provided that production has not yet begun. After this window, orders become final and may not be cancelled, except as set out in our Return and Refund Policy.

3.3 Personal and Non-Commercial Use

You represent and warrant that Products purchased through the Site are for personal or household use and not for commercial resale, distribution, or export. We reserve the right to refuse or cancel orders that we reasonably believe to be for commercial resale.

3.4 Returns and Refunds

Returns, refunds, exchanges, and remedies for defective or incorrect Products are governed exclusively by our Return and Refund Policy. By placing an order, you acknowledge that you have read and accepted that policy.

Section 4 — Pricing and Payment

4.1 Prices

Prices, discounts, and promotions are subject to change without notice. The price applicable to your order is the price displayed at the time you place your order, as confirmed in your order confirmation email.

Unless expressly stated otherwise, displayed prices do not include taxes, shipping fees, processing charges, customs duties, or import fees. These additional charges may apply depending on your delivery destination and will be calculated at checkout or invoiced separately where applicable.

4.2 Promotions

We may offer promotions or discount codes from time to time. Such promotions may be subject to additional terms separate from these Terms. In the event of a conflict, the promotion terms will prevail for that specific promotion.

4.3 Payment

We use Stripe as our payment processor. By placing an order, you represent and warrant that:

• The payment information you provide is accurate, complete, and current
• You are authorised to use the payment method selected
• The payment will be honoured by your card issuer or payment provider
• You will pay all amounts shown on your order, including applicable taxes, shipping fees, and any other charges

We do not store full payment card numbers. Payment data is processed and held by Stripe in accordance with PCI-DSS Level 1 security standards.

If a payment is declined, reversed, or disputed, we reserve the right to suspend or cancel your order and, where applicable, recover related costs from you.

Section 5 — Shipping and Delivery

5.1 International Shipping

We ship internationally via DHL Express. Shipping times communicated at the time of order are estimates only and are not guaranteed. Delivery dates depend on production timelines, courier performance, customs clearance, and events outside our control.

5.2 Production and Delivery Timelines

Because Products are made-to-order, the total time from order to delivery typically ranges between 4 and 8 weeks, depending on fabric availability and design complexity. The estimated production timeline is communicated at the time of order.

If you require delivery by a specific date (for example, a wedding or other special occasion), you must notify us in writing before placing your order and obtain written confirmation from us that the date is feasible. Only a written confirmation from our team constitutes a binding delivery commitment. Verbal assurances, social media messages, or generic production estimates do not constitute a binding delivery date.

5.3 Customs, Duties, and Import Taxes

For international shipments outside the country of dispatch, customs duties, VAT, and import taxes may apply at the destination. You are responsible for paying all such charges unless we explicitly agree otherwise at the time of order. Refusal to pay customs charges or to collect a delivered parcel does not entitle you to a refund — see our Return and Refund Policy, Section 7.

5.4 Risk and Title

Risk of loss and title to the Products pass to you upon delivery to the courier. Claims for loss or damage in transit must be reported to us within 7 calendar days of delivery, in accordance with our Return and Refund Policy.

Section 6 — Intellectual Property

6.1 Our Rights

The Services and all content available through them — including all trademarks, brand names, text, images, photographs, illustrations, graphics, product reviews, video and audio content, and the design, selection, and arrangement of such content — are owned by Betül Saday, our affiliates, or our licensors. They are protected by United Arab Emirates, European Union, United States, and international copyright, trademark, design, and other intellectual property laws.

"Betül Saday" and "Betül Saday Couture" are trademarks of BETUL SADAY COUTURE FZ-LLC. You may not use these marks without our prior written consent.

6.2 Limited Licence

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and use the Services for personal, non-commercial purposes only.

You may not:

• Reproduce, distribute, modify, adapt, translate, or create derivative works of any content from the Services
• Publicly display or perform, republish, download (except as technically required to view the Site), store, or transmit any content
• Use any content for commercial purposes, including advertising, training of artificial intelligence systems, or building competing products
• Use our trademarks, logos, brand names, or design elements without our prior written consent
• Remove or alter any copyright, trademark, or proprietary notices

All rights not expressly granted are reserved.

6.3 Shopify Intellectual Property

The name, logo, product names, service names, designs, and slogans of Shopify are trademarks of Shopify Inc. All other names, logos, product names, service names, designs, and slogans appearing on the Services are trademarks of their respective owners.

6.4 Copyright Infringement Notices

If you believe that any content on the Services infringes your copyright, please send a written notice to saday.betul@hotmail.com containing:

• A description of the copyrighted work claimed to have been infringed
• The exact URL where the alleged infringing content is located
• Your contact information (name, address, email, telephone)
• A statement that you have a good-faith belief that the use is not authorised
• A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorised to act on their behalf
• Your physical or electronic signature

Section 7 — Third-Party Links

The Services may contain links to third-party websites or materials, including social media platforms. We do not endorse, control, or assume responsibility for the content, accuracy, privacy practices, or terms of any third-party website. Accessing third-party websites is at your own risk. Please review the policies and terms of any third party before engaging with them.

Section 8 — Relationship with Shopify

Betül Saday is powered by Shopify, which enables us to make the Services available to you. However, any sale or purchase made through the Site is directly between you and Betül Saday. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sale, including any injury, damage, or loss arising from Products purchased. You hereby release Shopify and its affiliates from any claim, damage, or liability arising from or related to your purchases or transactions with Betül Saday.

Section 9 — Privacy

Personal data collected through the Services is processed in accordance with our Privacy Policy and, where applicable, the Shopify Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

Because the Services are hosted by Shopify, certain personal data is collected and processed by Shopify and may be transferred to and stored in countries other than your country of residence. For details, please see our Privacy Policy.

Section 10 — User Feedback and Reviews

10.1 Feedback Licence

If you submit, upload, share, or transmit any idea, suggestion, comment, review, photograph, or other content (collectively, "Feedback") to us through the Services or otherwise, you grant Betül Saday a perpetual, worldwide, sublicensable, royalty-free, irrevocable licence to use, reproduce, modify, adapt, publish, distribute, and display such Feedback in any medium and for any purpose, including commercial use.

We may use this licence to operate, provide, evaluate, develop, improve, and promote the Services, and to fulfil our rights and obligations under these Terms.

10.2 Your Representations

By submitting Feedback, you represent and warrant that:

• You own or have all necessary rights to the Feedback
• The Feedback does not infringe any third-party rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights
• The Feedback does not contain defamatory, unlawful, abusive, or obscene material
• The Feedback does not contain viruses, malware, or any other harmful code
• You have disclosed any compensation or incentive received in connection with the Feedback

10.3 Moderation

We may, but are under no obligation to, monitor, edit, or remove Feedback that we determine to be unlawful, offensive, threatening, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.

We assume no responsibility or liability for Feedback posted by you or any third party.

Section 11 — Errors and Inaccuracies

The Services may contain typographical errors, inaccuracies, or omissions related to Product descriptions, pricing, promotions, shipping fees, delivery times, or availability. We reserve the right to correct any such errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Services is inaccurate at any time, even after you have submitted your order.

Section 12 — Prohibited Uses

You may access and use the Services only for lawful purposes. You may not access or use the Services directly or indirectly:

• For any unlawful, fraudulent, or malicious purpose
• To violate any international, national, federal, regional, or local law or regulation
• To infringe our intellectual property rights or those of any third party
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or threaten any person
• To submit false or misleading information
• To upload or transmit viruses, malware, or any other type of malicious code
• To collect or track the personal data of others
• To engage in spam, phishing, or fraud
• To use any automated means (robots, scrapers, data-mining tools, AI agents) to access or copy the Services
• To interfere with, circumvent, or disable security features of the Services
• To reproduce, copy, sell, resell, or exploit any part of the Services for commercial purposes
• To use the Services in any way that could damage, disable, overburden, or impair the Services

We reserve the right to suspend or terminate your access to the Services at any time, without notice, if we reasonably believe you have violated these Terms.

Section 13 — Termination

We may terminate or suspend your access to the Services (or any part of them) at any time, in our sole discretion, with or without notice, including for any breach of these Terms. You remain liable for all amounts due up to and including the date of termination.

The following sections survive termination of these Terms: Intellectual Property, Feedback, Privacy, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and any other provisions that by their nature should survive.

Section 14 — Disclaimer of Warranties

The information provided through the Services is for general informational purposes only. We make no warranty regarding the accuracy, completeness, or usefulness of any information. Any reliance you place on such information is strictly at your own risk.

Except as expressly stated by us, the Services and all Products provided through the Services are provided "as is" and "as available", without any representation, warranty, or condition of any kind, whether express or implied. This includes any implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, durability, title, or non-infringement.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.

Your statutory rights as a consumer — including any rights under EU Directive 2019/771 on the sale of goods, the UAE Consumer Protection Law, and equivalent legislation in your country of residence — are not affected by this disclaimer.

Section 15 — Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Betül Saday, its affiliates, directors, officers, employees, agents, contractors, service providers, or licensors (or those of Shopify and its affiliates) be liable for any indirect, incidental, special, punitive, consequential, or exemplary damages — including, without limitation, loss of profits, revenue, savings, data, goodwill, or substitute costs — arising out of or in connection with your use of the Services or any Products, regardless of the legal basis (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Where applicable law does not permit the exclusion or limitation of certain liabilities, our liability shall be limited to the amount paid by you for the Product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Defective products under applicable consumer protection laws
• Any other liability that cannot be excluded or limited under applicable law

Section 16 — Indemnification

You agree to indemnify, defend, and hold harmless Betül Saday, Shopify, and their respective affiliates, partners, directors, officers, employees, agents, contractors, licensors, and service providers from and against any third-party claim, demand, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of or in connection with:

• Your breach of these Terms or any policy referenced herein
• Your violation of any applicable law or third-party right
• Your use of or access to the Services

We will notify you of any such claim. We may, at our own expense, assume the defence and settlement of any such claim, including selection of counsel, provided that we will not agree to any non-monetary settlement requiring action by you without your consent (which shall not be unreasonably withheld). You agree to cooperate in the defence of such claims by providing relevant documents and information.

Section 17 — Consumer Rights (EU, UK, and Other Jurisdictions)

If you are a consumer resident in the European Union, the European Economic Area, the United Kingdom, or another jurisdiction providing mandatory consumer protection, the following applies:

• Nothing in these Terms shall deprive you of mandatory consumer rights under the law of your habitual residence
• Your right to bring legal proceedings in the courts of your country of residence is not affected
• Where the laws of your country of residence provide for a stricter standard of consumer protection than these Terms, that standard will apply
• EU Online Dispute Resolution: EU consumers have the right to refer disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/

Section 18 — Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.

Section 19 — Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Return and Refund Policy, Privacy Policy, Cookie Policy, and any other policies published by us on the Site, constitute the entire agreement between you and Betül Saday regarding your use of the Services. They supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

Section 20 — Assignment

You may not assign, transfer, or sublicense these Terms or any of your rights or obligations under them without our prior written consent. Any such attempted assignment shall be void. We may assign, transfer, or sublicense these Terms and our rights and obligations to any of our affiliates or successors without notice or consent.

Section 21 — Governing Law and Jurisdiction

These Terms, and any separate agreement by which we provide you with the Services, are governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates, except where mandatory consumer protection law in your country of habitual residence grants you the right to bring proceedings before the courts of that country (see Section 17).

Section 22 — Changes to These Terms

You may review the most current version of these Terms at any time on this page.

We reserve the right to update, modify, or replace any part of these Terms at our sole discretion by posting changes to the Site. It is your responsibility to check this page periodically. We will notify you of any material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice.

Your continued use of or access to the Services after any changes are posted constitutes your acceptance of those changes.

Section headings used in these Terms are for convenience only and do not limit or otherwise affect the interpretation of these Terms.
